Joseph H Does anybody actually know for a fact if the 3P companies are actually infringing on any IP's? If so what laws are protecting them? Chinese? International? US? Bullet points in International Trade Deals?

When 3rd party comes up, the discussion is always around IP infringement and Hasbro; there's a U.S. slant. But most of the G1 designs predate Hasbro. For arguments sake, let's say Takara Diaclone Cassetteman (Soundwave) is in Japanese Public Domain by now. Couldn't I, as a third party, make my own version of "Cassetteman" and be in the free and clear, since it's Casetteman, not Soundwave I'm homaging?
I love the show, it's the only TF podcast I listen to at 1x speed instead of 2x speed so I can get every nuance. I also recommend you guys to my non-TF friends looking for something to listen to.

I know a lot of people are against KOs because it's like stealing money/sales from the originator, but aren't used items essentially the same thing?
